DMCA Policy

Summary

If your copyrighted work appears on Elska without permission, send our agent a notice with the six elements listed below and we will remove it. If your content was removed by mistake, you can send a counter-notice.

1. Designated agent

Harnika Bajaj responds to notices under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512, and to equivalent notices under other applicable law. Send notices to:

2. What a notice must contain

To be effective under § 512(c)(3), your notice must include all of the following:

  1. a physical or electronic signature of the copyright owner or someone authorised to act for them;
  2. identification of the copyrighted work claimed to have been infringed;
  3. identification of the material claimed to be infringing, with enough detail for us to locate it — a direct link is best;
  4. your address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  6. a statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner.

An incomplete notice may not trigger our obligations. Note that § 512(f) imposes liability for knowing misrepresentation — sending a notice about material you do not own, or that is plainly fair use, can make you liable for damages and costs.

3. What we do

On receiving a complete notice we expeditiously remove or disable access to the material, take reasonable steps to notify the user who posted it, and give them a copy of the notice.

4. Counter-notice

If your material was removed by mistake or misidentification, send a counter-notice to ffan45972@gmail.com containing:

  1. your signature;
  2. identification of the material and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where you live (or, if outside the United States, of any district in which we may be found), and that you will accept service of process from the complainant.

We forward the counter-notice to the complainant. Unless they tell us within 10 business days that they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.

5. Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. We keep a record of notices for this purpose.

6. Not a route for other complaints

This process is only for copyright. For content that depicts you without consent, use the Content Removal Policy (ffan45972@gmail.com); for material involving a minor, see the Underage Policy — both are faster than a copyright notice.
